Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Blokwev platform ("Service"), operated by Blokwev ("we", "us", or "our"), a company based in Virginia, United States. By creating an account or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Description of Service

Blokwev is a SaaS platform for system design interviews and learning. It provides two primary offerings:

• Business (B2B): Tools for organizations to conduct live system design interviews, including a collaborative canvas, AI scoring, chaos scenarios, performance reports, and timed candidate assessments.
• Individual (B2C): A practice platform for individuals to solve system design problems and receive AI-driven feedback.

2. Accounts & Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By creating an account, you represent that you meet these requirements.

You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@blokwev.com if you suspect unauthorized access to your account. We are not liable for losses arising from compromised credentials.

Business accounts may invite members to their organization. Organization administrators are responsible for the conduct of all members within their account.

3. Subscriptions & Payment

Business Plans

Business subscriptions are available on monthly or annual billing cycles. Plans include Selective, Steady, and Surge tiers, each with defined monthly limits for sessions, assessments, and AI reviews. New accounts receive a 14-day free trial with no credit card required.

Individual Plans

Individual subscriptions are available as a monthly Pro plan or an Annual plan. A free tier is available with limited monthly practice attempts.

Billing

Payments are processed by Stripe. By subscribing, you authorize Stripe to charge the payment method on file on a recurring basis. All prices are in USD. We reserve the right to change pricing with 30 days' notice to existing subscribers.

Taxes

You are responsible for any applicable taxes, duties, or levies arising from your use of the Service.

4. Cancellation & Refunds

You may cancel your subscription at any time. Upon cancellation, your access will continue until the end of the current billing period. We do not provide prorated refunds for unused time within a billing period except where required by law.

Annual plan subscribers who cancel within 14 days of their initial purchase may request a full refund by contacting support@blokwev.com. Refund requests after this window are evaluated on a case-by-case basis.

Free trial users are never charged unless they actively choose to subscribe.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Share account credentials or session access tokens with unauthorized parties
• Attempt to reverse engineer, decompile, or extract source code from the platform
• Use automated tools to scrape, crawl, or extract data from the Service
• Attempt to circumvent plan limits, billing controls, or access restrictions
• Upload or transmit malicious code, viruses, or harmful content
• Use the AI features to generate content that violates applicable laws or third-party rights
• Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these terms without notice.

6. Intellectual Property

Our IP

All software, design, content, trademarks, and technology comprising the Blokwev platform are owned by or licensed to us. Nothing in these Terms grants you ownership of our intellectual property.

Your Content

You retain ownership of any diagrams, notes, problem statements, and other content you create on the platform ("User Content"). By using the Service, you grant us a limited, non-exclusive license to host, store, and process your User Content solely to provide the Service to you.

We do not use your User Content to train AI models without your explicit consent.

7. AI Features & Limitations

Blokwev uses AI (powered by Anthropic Claude) to generate interview scores, feedback, and chaos scenario evaluations. AI-generated content is provided for informational and educational purposes only.

AI scores and reviews are not a substitute for professional judgment. We make no representations about the accuracy or completeness of AI-generated feedback. You are solely responsible for any hiring or assessment decisions made using the platform.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLOKWEV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claims arising from these Terms or the Service shall not exceed the total fees paid by you in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Blokwev and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Virginia, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
